Terms of Service

These Terms of Service are effective August 5, 2026. They are an agreement between Shekar Labs and the business or other legal entity that accesses or uses Monshi. Monshi is the product and service brand operated by Shekar Labs.

By creating an account, signing an order form, using the dashboard, connecting messaging or calendar workflows, or otherwise using Monshi, you agree to these terms. If you use Monshi on behalf of a business, you represent that you have authority to bind that business.

Monshi is a SaaS platform for businesses. It may include missed-call recovery, SMS communication automation, AI-assisted replies, appointment and quote workflows, business knowledge responses, reporting, setup support, and related features.

Monshi is designed to assist business communications. It does not replace your staff, legal judgment, compliance program, professional advice, emergency systems, or customer-facing policies.

You must provide accurate account, billing, and business information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must promptly notify Shekar Labs if you believe your account has been compromised or used without authorization.

You retain your rights in your business data, customer data, message content, knowledge-base content, service details, appointment information, and other content you submit to Monshi. You grant Shekar Labs the limited rights needed to host, process, transmit, display, secure, troubleshoot, and improve Monshi in accordance with these terms and applicable agreements.

You are responsible for the accuracy, legality, quality, and appropriateness of your data and content, including customer phone numbers, consent records, service descriptions, pricing, appointment availability, business policies, and knowledge-base materials.

You are responsible for obtaining all required consents and providing all required notices before calling, texting, or otherwise contacting any person through Monshi. You must comply with the Telephone Consumer Protection Act, CTIA and carrier rules, CAN-SPAM where applicable, privacy laws, consumer protection laws, and all other local, state, and federal laws that apply to your communications.

You must honor opt-outs immediately, maintain appropriate suppression lists, avoid contacting reassigned or wrong numbers, and avoid sending messages to people who have not provided legally sufficient consent. You may not use Monshi for spam, harassment, fraud, deceptive activity, illegal activity, or abusive messaging.

You may not use Monshi to process sensitive or regulated data, including protected health information, without an appropriate written agreement with Shekar Labs. You are responsible for your own customer-facing privacy notice, SMS consent language, terms, and compliance documentation.

Monshi is not an emergency service. Do not use Monshi for 911, urgent medical, safety-critical, disaster response, or other emergency communications. You are responsible for providing customers with appropriate emergency contact instructions outside Monshi.

Monshi may use AI-assisted features to draft or send replies, classify customer intent, answer questions from configured business information, collect appointment or quote details, and support workflows. AI output can be wrong, incomplete, delayed, or inappropriate for a particular situation.

You are responsible for configuring workflows, reviewing business information, monitoring communications, and making final business decisions. You remain responsible for appointments, pricing, quotes, customer promises, staff handoffs, and communications sent through your account.

Monshi may depend on third-party services such as carriers, Twilio, Google or Outlook calendar services, Stripe or other payment processors, OpenAI or other AI/model providers, cloud infrastructure providers, analytics services, and support tools.

Third-party services may be subject to their own terms, policies, outages, limits, carrier filtering, delivery rules, rate limits, changes, or errors. Shekar Labs is not responsible for third-party outages or actions outside its reasonable control, and we do not guarantee uninterrupted access, SMS delivery, calendar availability, payment processing, or AI accuracy.

You agree to pay the fees shown at checkout, in an order form, or in another written agreement for your purchase. Fees may include subscriptions, usage-based charges, setup services, messaging costs, taxes, or other charges identified when you buy or renew.

By providing a payment method, you authorize Shekar Labs or its payment processor to charge applicable fees, renewals, taxes, and other amounts due. Subscription plans may renew automatically unless canceled according to the applicable purchase terms.

Current pricing and any refund, guarantee, trial, or promotional terms shown at checkout or in your order form control for that purchase. We may suspend or limit access for non-payment, payment disputes, fraud risk, or billing issues.

Standard subscription refunds: You may request a refund through Monshi support within 30 calendar days of successful initial payment and subscription activation. This window starts at payment/activation, not Early Access submission or tenant creation.

Founding60 promotional guarantee: The initial $199 payment provides 60 days of Pro, with the normal $499 guided onboarding & launch setup included at no additional charge. There is no separately charged setup amount under founding60. You may request a refund during the 60-calendar-day window starting when that initial payment is successfully collected and subscription activation begins. The refund is the initial $199 less direct, identifiable third-party usage costs incurred specifically for your account, such as SMS/telephony usage or other reliably measurable, directly attributable metered third-party usage. This is not a promise of a full refund.

Founding60 deductions do not include shared hosting or infrastructure overhead, database allocation, engineering time, onboarding labor, internal support costs, or administrative fees. Refund requests are handled manually through Monshi support at info@getmonshi.com.

After the 60-day offer period, Pro automatically renews at $299/month unless canceled. Contact Monshi support before renewal to cancel. The founding guarantee applies only to the initial $199 payment; later renewal charges are not covered by that guarantee. When you request a founding guarantee refund, Monshi support will cancel future renewal unless you explicitly ask to keep your subscription active.

You may cancel according to the process provided in the dashboard, checkout flow, order form, or support instructions. Shekar Labs may suspend or terminate access if you breach these terms, create security or compliance risk, misuse the service, fail to pay amounts due, or use Monshi in a way that may harm Shekar Labs, customers, providers, carriers, or other users.

After cancellation or termination, your access may end and active workflows may stop. Where technically feasible and subject to payment, security, legal, and contractual obligations, Shekar Labs may provide a reasonable opportunity to export customer data.

You may not use Monshi to violate law, infringe rights, send unlawful or unwanted communications, scrape or harvest data, interfere with the service, bypass security controls, reverse engineer the platform, overload infrastructure, transmit malware, or misrepresent your identity or relationship with any person.

Shekar Labs may investigate suspected abuse and may suspend or terminate accounts, workflows, messages, or integrations that appear illegal, abusive, harmful, high-risk, or non-compliant.

Shekar Labs owns Monshi, including the software, platform design, workflows, documentation, branding, templates, and other service materials. Subject to these terms, Shekar Labs grants you a limited, non-exclusive, non-transferable, revocable right to access and use Monshi for your internal business purposes.

You retain rights to your own data and content. You may provide feedback, suggestions, or ideas, and Shekar Labs may use them without restriction or obligation to you.

Each party may receive non-public business, technical, product, pricing, security, or operational information from the other party. The receiving party will use reasonable care to protect confidential information and will use it only to perform under these terms, except where disclosure is permitted by the disclosing party or required by law.

To the maximum extent permitted by law, Monshi is provided "as is" and "as available." Shekar Labs disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, guaranteed message delivery, guaranteed leads, guaranteed bookings, guaranteed revenue, and guaranteed AI accuracy.

You are responsible for determining whether Monshi is appropriate for your business, industry, compliance obligations, workflows, and customers.

To the maximum extent permitted by law, Shekar Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, lost data, business interruption, or substitute services.

To the maximum extent permitted by law, Shekar Labs' total liability for all claims relating to Monshi or these terms will not exceed the amounts you paid to Shekar Labs for Monshi during the 12 months before the event giving rise to the claim. This limitation does not exclude liability that cannot legally be excluded.

You will defend, indemnify, and hold harmless Shekar Labs from claims, damages, losses, liabilities, costs, and expenses arising from your unlawful use of Monshi, your data or content, your messaging practices, your failure to obtain consent or honor opt-outs, your customer relationships, or your breach of these terms.

These terms are governed by the laws of Florida, United States, without regard to conflict-of-law rules. Courts located in Florida will have venue for disputes relating to these terms or Monshi, except where non-waivable law gives you different rights.

Shekar Labs may update these terms from time to time. Updated terms will be posted on this page or otherwise provided as appropriate. Continued use of Monshi after an update means you accept the updated terms.

Notices may be provided electronically, including by email, dashboard notice, or website posting. You may not assign these terms without Shekar Labs' consent. Shekar Labs may assign these terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or similar transaction.

If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These terms, together with any applicable order form or written agreement, are the entire agreement for your use of Monshi.
